Dental board faces lawsuit over direct-to-consumer orthodontics

SmileDirectClub LLC filed a lawsuit last week in federal court that alleges the Dental Board of California conspired to hurt the company’s business. The lawsuit came several days after Gov. Newsom signed AB 1519, which establishes fundamental consumer protections for patients who receive dental treatment via telehealth. The plaintiffs claim that dentists serving on the dental board have undertaken “an aggressive, anti-competitive campaign” against SmileDirectClub, its affiliated dental practices and its direct-to-consumer business model.
Gift card scam targets dentists, dental professionals in California

A current email scam is using the name of CDA President Del Brunner, DDS, in an attempt to trick the recipient into purchasing a high-value gift card from a multinational retailer. As of this writing, CDA has not received any reports from members who have received the imposter email but has confirmed that the emails are circulating to individuals in the California dental field.

Dental supply class-action settlement notices mailed

Dentists eligible for payments as part of an $80 million class-action settlement involving dental supply companies Henry Schein Inc., Patterson Companies Inc. and Benco Dental Supply Company have received notices informing them that they have until Oct. 15 to file a claim in order to receive a payment, pending final settlement approval.
Deadline to cash Delta Dental settlement checks approaching

Delta Premier Providers who are class members of the Delta Dental class action lawsuit have until June 14, 2019, to cash their settlement checks. The $65 million settlement is the result of legal action CDA filed against Delta on behalf of members. Most settlement checks sent to approximately 14,000 class members have been cashed, but the class action settlement administrator reports that more than 500 settlement checks have yet to be cashed.
Dental anesthesiology recognized as a specialty

Dental anesthesiology has become the 10th dental specialty recognized by the National Commission on Recognition of Dental Specialties and Certifying Boards. The commission adopted a resolution in March based on an application from the American Society of Dentist Anesthesiologists to recognize dental anesthesiology as a dental specialty.

Prop. 56 dentists loan repayment program opens April 1, awards up to $300K

A new loan repayment program is available for dentists and physicians who provide direct patient care to Medi-Cal beneficiaries. Eligible dentists may apply through Physicians for a Healthy California to receive up to $300,000 to apply toward their student loans in exchange for a five-year service obligation as a Medi-Cal provider.
Financial assistance available to dentists impacted by California wildfires

The CDA Foundation is accepting applications for the Disaster Relief Grant. The grant assists dentists, dental staff and component staff members with immediate and emergency needs as a direct result of the Camp Fire in Northern California’s Butte County and the Woolsey and Hill fires affecting Ventura and Los Angeles counties. The one-time, single-installment grant provides financial assistance of up to $5,000. Applicants who have lost a home may request additional funds for dependent, immediate family members.
Smokeless tobacco prevention summit convenes Oct. 16-18 in Sacramento

More than 400 national experts, health care providers and advocates will participate in the 9th National Summit on Smokeless Tobacco Prevention coming to Sacramento Oct. 16-18. Individuals, organizations and agencies committed to reducing and eliminating the use of smokeless and other noncombustible tobacco products are encouraged to register to join the current coalition.

Encourage patients to 'take them back' to help prevent addiction, overdose

The next DEA National Prescription Drug Take Back Day is set for Saturday, Oct. 27, and more than 300 locations in California are prepared to help people dispose of unused prescription drugs safely and anonymously. Health care providers can encourage their patients and others to dispose of prescription drugs from 10 a.m. to 2 p.m. Patients should also be made aware that they can also dispose of unused prescription drugs year-round at designated locations.
Disaster assistance available for Denti-Cal providers, beneficiaries

Denti-Cal providers and beneficiaries in nine counties impacted by the Carr and Cranston fires will receive processing exceptions to expedite replacement of removable dental appliances, a special Denti-Cal Bulletin states. According to the August Bulletin, claims will be accepted without requiring prior authorization and will not be rejected due to frequency limitations for subsequent removable appliances for eligible beneficiaries.
Dental professionals impacted by wildfires can apply for disaster relief grant

To help dental professionals in need, the CDA Foundation has established a Disaster Relief Grant for individuals — a one-time, single-installment grant that provides financial assistance of up to $5,000 per California dentist, dental staff member currently employed in the dental field or CDA component dental society staff member. The grant is for immediate and emergency needs as a direct result of the 2018 California wildfires.
FDA warns against use of OTC benzocaine teething products

The FDA has taken action to stop the use of over-the-counter benzocaine oral health products for young children, stating that the products “pose serious safety risks, especially those with no demonstrated benefit.” In addition to warning consumers that these products, which are intended for the temporary relief of sore gums due to teething, pose a serious risk to infants and children, the administration has asked companies to stop selling the products for such use.

Phone scam targets California dental practice

In a scam reported as early as February that appears to be ongoing, criminals are posing as Pacific Gas and Electric Co. representatives who either demand immediate payment of utility bills they claim are past due or attempt to cross-sell products and services, such as solar power. Initially centered in the San Francisco Bay Area, the fraudulent calls have now reached most of the state.
Completion of 2017 Economic Census required

CDA has learned that the U.S. Census Bureau has contacted some dental practices asking that they complete the 2017 Economic Census. Any business that receives the letter is required by law to electronically provide the requested information according to the letter’s instructions. Failure to submit information may lead to a penalty of up to $5,000.
CDA secures final court approval of $65M Delta Dental settlement for dentists

A San Francisco Superior Court judge has granted final approval of the $65 million amended settlement agreement between Delta Dental of California and the plaintiff class of Premier dentists. The comprehensive settlement is the result of a lengthy legal battle that CDA initiated in 2013 after learning of Delta Dental’s plans to reduce Premier provider rates by 8 to 12 percent. CDA brought the litigation in order to protect the rights of its members and to require Delta Dental to honor the terms of its contracts.

ADA advances national policy to reduce opioid dependency

The ADA on March 26 adopted a new policy to combat the opioid epidemic, calling it the potential first of its kind by a major health professional organization to support mandates on opioid prescription limits and continuing education. “I call upon dentists everywhere to double down on their efforts to prevent opioids from harming our patients and their families,” said ADA President Joseph P. Crowley, DDS, in a press release. The Interim Board Policy on Opioid Prescribing addresses continuing education, dosage and duration, and prescription and drug monitoring.

Applications being accepted for ADA Foundation Dental Student Scholarships of $20K

Second-year dental students who meet eligibility requirements should apply by Friday, Feb. 2, 2018, for an ADA Foundation Dental Student Scholarship. The Foundation’s scholarship program recognizes dental students who are strong academically and who demonstrate outstanding promise in leadership, public service, volunteerism and/or research. The ADAF will award up to seven scholarships valued at $20,000 each.

In a hearing on Dec. 27, a San Francisco Superior Court judge granted preliminary approval of the amended settlement agreement between Delta Dental of California and the plaintiff class of Premier dentists. After an error in the financial calculations was discovered during the validation CDA required of the prior settlement amounts, the new settlement includes an agreement by Delta Dental to pay an unprecedented monetary award of more than $65 million and expands the number of dentists eligible for awards to more than 14,000.
New CDA president begins term

Natasha Lee, DDS, is CDA’s new president for 2018. Lee, a practicing general dentist in the Sunset District of San Francisco, is a graduate of the University of the Pacific, Arthur A. Dugoni School of Dentistry class of 2000. With more than 17 years of experience as a dental educator, Lee spent over a decade teaching preclinical restorative techniques and is now an assistant professor and course director of Practice Management and Jurisprudence at Pacific Dugoni.
CDA negotiates larger settlement for Delta Dental Premier dentists

The revised settlement includes an agreement by Delta Dental to pay an unprecedented monetary award that nearly doubles the amount the parties had previously agreed upon to more than $65 million.
Stockton-based dentist with ‘huge heart for the underserved’ receives humanitarian award

Not even an oral cancer diagnosis in 2012 could slow down Lester Low, DDS, recipient of the 2017 CDA Foundation Humanitarian Award. Early diagnosis and treatment helped Dr. Low beat squamous cell carcinoma of the tongue, but throughout his treatment he continued to volunteer his time and services for several organizations in the San Joaquin Valley, a few with which Low has been volunteering for more than 20 years.

The offices will reopen Tuesday, Jan. 2. To offset this closure, CDA and its subsidiary companies were open for business on certain holidays throughout the year.

Protect dental coverage for millions: Urge your representatives to extend CHIP funding

California’s CHIP funding will run out next month and the state will be confronted with a huge budget gap for CHIP children’s Medi-Cal coverage, potentially as much as $1 billion dollars or more. CDA is calling on dentists to act now to protect dental and health care coverage for millions of children and pregnant women in California. Contact your senators and representative in Congress to urge them to take swift action to extend CHIP funding.
CDA supports dental communities in natural disasters

In response to recent natural disasters in California, Texas, Florida and the Caribbean, CDA has provided financial donations to help dental professionals with relief efforts. CDA donated $10,000 to assist the Colegio de Cirujanos Dentistas de Puerto Rico with disaster relief in the aftermath of Hurricane Maria that struck the U.S. territory in late September. Additionally, CDA and TDIC made donations to dental associations to assist with relief efforts, including $40,000 to the Texas Dental Association in the wake of Hurricane Harvey.
$295M settlement reached on behalf of Stericycle customers

A $295 million settlement has been reached on behalf of a nationwide class of Stericycle customers, following a class-action lawsuit accusing the company of engaging in a price-increasing scheme that automatically inflated customers’ bills up to 18 percent biannually, according to a news release from Hagens Berman, the Chicago-based law firm that represented the class.
Delta hearing scheduled for Oct. 11

The Dentists Service Company launched to support members

A San Francisco Superior Court judge has delayed dates related to CDA’s proposed settlement agreement with Delta Dental — the June 26 deadline to opt out or object to the proposed settlement and the Aug. 31 hearing on final approval. The action will provide additional time for CDA, Delta Dental and the court to review procedures that were used to estimate the impact of the inflation adjustment percentage (INAP). Delta Dental’s INAP is the basis for the alleged underpayment to class members.
State budget more closely honors will of Prop. 56 voters

Gov. Jerry Brown and the California Legislature engaged in heated negotiations before passing a final budget by a constitutionally mandated deadline of June 15. A major focus of those negotiations was the use of Proposition 56 tobacco tax revenues, for which CDA and its partners engaged in an internal and external advocacy campaign.
Delta Dental proposed settlement notices mailed

Dentists who are part of a class action lawsuit against Delta Dental of California should have received by mail a notice of the proposed settlement. Preliminary approval of the proposed settlement by a San Francisco Superior Court judge on April 21 triggered a settlement administrator to issue formal notices to dentists who are part of the class. The notices were mailed on May 11.

A San Francisco Superior Court judge has granted preliminary approval of a proposed settlement between CDA and Delta Dental of California. The preliminary approval triggers a settlement administrator to issue formal notices to the class of dentists who are affected by the proposed settlement. Dentists should expect to receive their formal notices in the mail in mid-to-late May.
Action needed to remain on Denti-Cal patient referral list

Each year, the Denti-Cal patient referral list is “refreshed” to help ensure it is current and accurate. Toward this goal, dentists who were added to the Denti-Cal patient referral list prior to Dec. 1, 2016, and who wish to remain on the list must complete and submit a new Medi-Cal Dental Patient Referral Service form within 35 business days of receiving the form. The form was mailed to providers on March 10.

Protected health information at risk, FBI warns

The FBI in a private industry notification warned health care providers that cybercriminals are actively targeting File Transfer Protocol (FTP) servers "operating in ‘anonymous’ mode and associated with medical and dental facilities to access protected health information (PHI) and personally identifiable information in order to intimidate, harass and blackmail business owners."

Fraudulent OCR email targets HIPAA-covered entities

The U.S. Department of Health and Human Services on Nov. 28 issued an alert regarding a phishing email that is currently circulating on mock HHS departmental letterhead with a signature from Office of Civil Rights Director Jocelyn Samuels. HHS notes that the email “appears to be an official governmental communication, and targets employees of HIPAA covered entities and their business associates.”

Medicare Part D enrollment deadline now January 2019

The Centers for Medicare and Medicaid Services has again extended the deadline for dentists to either enroll as a Medicare Part D "ordering/referring provider" or opt out of the Medicare program entirely. The previous deadline was Feb. 1, 2017, but it has now been extended to Jan. 1, 2019.

Dentists warned of waste management misinformation

CDA has learned from members and a state agency that  dentists have been contacted by a national waste management service company  that is providing misinformation about regulatory requirements. The calls claim that dentists must register with the  California Department of Public Health as a "hazardous waste generator," or  that dental practices must comply with "new" regulations specifically for  pharmaceutical waste.
Give Kids a Smile registration underway

CDA's new president begins term

Ken Wallis, DDS, is CDA’s new president for 2015-16. Wallis, a general dentist with a private practice in Santa Clara, is a graduate of Loma Linda University School of Dentistry. He succeeds Immediate Past President Walt Weber, DDS. Wallis said changes occurring in the dental profession, including the growth of new practice models, provide an opportunity for inclusiveness.
CDA earns membership awards

As a reflection of CDA’s diverse membership and commitment to serving all dentists in a variety of practice settings, the ADA recently awarded CDA with three membership awards. Among dental societies with more than 7,500 members, CDA received the membership awards in the categories of Greatest Percentage of Diverse Members, Greatest Percentage of New Dentists and Greatest Percentage of Women Dentists.

Governor announces California state dental director

Gov. Jerry Brown today announced that Jayanth V. Kumar, DDS, MPH, will serve as California's new state dental director. For years, CDA has advocated for a state dental director — the establishment of this position is a major achievement for the state's oral health program and access to care planning goals.

New CDA president on how to best serve members

Walter G. Weber, DDS, was installed as the new CDA president last week at the House of Delegates meeting in San Diego. During his speech to delegates, Weber emphasized the importance of CDA continually looking for ways to best serve its members in the profession's changing landscape. Current trends in dentistry, including shrinking dental insurance benefits, pressures to reduce costs, and increasing costs of dental education, make it important for CDA to understand members' needs and develop strategies to help them succeed and best serve patients, he said.

CDA & ADA surveying to understand dental capacity

CDA is working with ADA’s Health Policy Institute on an analysis of the capacity of the California dental care system. CDA and local dental advocacy efforts in recent weeks have prompted action from the state, led by Sen. President Pro Tem Darrell Steinberg and the Department of Health Care Services, to ensure access to dental care performed under anesthesia when medically necessary. Inadequate Medi-Cal reimbursement rates for facility, anesthesia and dental services have forced many facilities statewide to either reduce or discontinue dental services for patients who need to be treated under general anesthesia.

CDA Cares was recently selected as a Daily Point of Light Award honoree for the work the CDA Foundation has done through the volunteer dental program. The Daily Point of Light Award was established by President George H.W. Bush to recognize the power of individuals and groups to spark change and improve the world. In a letter sent to the CDA Foundation from the Points of Light program, the efforts of CDA Cares were said to “honor the legacy of this award, demonstrating the power of service to create tangible change … Your efforts are a remarkable example of the generosity and compassion that make our communities stronger and better.”

Counties mandate flu precautions for health care workers

On behalf of its members, the California Dental Association — along with several individual dentist providers — has taken legal action against Delta Dental of California by filing a demand for binding arbitration in response to Delta’s notice dated Aug. 1, informing providers of changes to key provisions in their agreements.
CDA launches electronic newsletter

CDA members are now receiving an electronic newsletter once every two weeks that allows them to select which topics they wish to receive news articles and updates about. In total, there are 12 topics members will be able to choose from including CDA Cares, CDA Presents, Education, Legislation, Practice Support and TDIC Risk Management. The electronic newsletter comes in a mobile-friendly design and is visually appealing on smartphones and tablets.
Update and Journal ePubs now available

Remembering ‘Lion of a man’ Dr. J. David Gaynor, TDIC founder

Dr. David Gaynor, past CDA president and co-founder of The  Dentists Insurance Company, passed away January 14 at the age of 81, following  complications from pneumonia.
