Beginning January 1, 2023, employers of 15 or more employees must include the pay scale in any job posting, including those placed with or by a third party.
“Pay scale” means the salary or hourly wage range that the employer expects to pay for the position. Employers should be mindful that if the wage paid for a position is a flat hourly wage (for example $20/hr.), the employer has limited flexibility in paying a well-qualified candidate more than the posted hourly wage without risk of non-compliance with the law.
Upon request, employers must provide current employees with the pay scales for their positions.
Applicants may request a pay scale for the position for which they are applying, even if they do not interview.
Employers must maintain records of job title and wage history for each employee for the duration of employment, plus three years after separation.
Penalties for non-compliance are costly. No penalty for missing salary requirements will be assessed by the Labor Commissioner for the first violation if the employer updates all job postings to include the applicable pay scale.
