State rules online discount contracts violate law

The Legal Division of the California State Department of Consumer Affairs (DCA) has released a legal opinion concluding that a contractual arrangement between a health care professional and an Internet marketing service (Groupon, Living Social, etc.) offering online discounts for medical services violates state law. The U.S. Department of Health and Human Services (HHS) published the long-awaited final omnibus rule under HIPAA (Omnibus Rule) on Jan. 25, 2013. The rule implements the Health Information Technology for Economic and Clinical Health Act (HITECH) and requires that health care providers amend their Notice of Privacy Practices (NPP) and Business Associate Agreements to include new elements. The compliance date for the final rule is Sept. 23, 2013. Read more >>

California employers have until Dec. 1, 2013, to train employees on the new hazard label elements and safety data sheet format required by the Cal/OSHA Hazard Communication Regulation. Cal/OSHA recently amended the state regulation to conform to federal regulation and the United Nations’ Globally Harmonized System of Classification and Labeling of Chemicals (GHS). Mixed news for Denti-Cal adult benefits

Two significant but conflicting developments in the longstanding effort to rebuild the oral health care safety net in California have occurred. In a disappointing move, on the same day that the state Senate Budget and Fiscal Review Committee endorsed restoring Medi-Cal adult dental benefits, the U.S. 9th Circuit Court of Appeals on May 24 denied a petition filed by CDA and a coalition of health care organizations aiming to stop the state from implementing a 10 percent reduction in Medi-Cal provider reimbursement rates. CDA is sponsoring legislation to apply key patient protections and market reforms, including a minimum loss ratio on patient premiums, to dental plans participating in California’s new health plan marketplace, the Covered California health benefit exchange. The Affordable Care Act (ACA) includes many consumer-focused provisions that have already gone into effect, but that only apply to medical plans. Assemblymember Dr. Richard Pan (D-Sacramento), who chairs the Assembly Health Committee, has introduced AB 18, sponsored by CDA, that if passed by the legislature and signed by the Governor, would represent the first time these federal patient protections would be applied to dental plans participating in the small group market inside and outside the new health benefit exchange created by ACA. Dentists support CDA Cares by sponsoring chairs

As the CDA Foundation plans for the CDA Cares free dental clinic in San Diego in December, many members are doing everything they can to help make sure the clinics are a success, even if they can’t physically be there to volunteer. Through the Foundation’s “sponsor a dental chair” program, dentists can donate $500 toward providing patients a place to receive essential care at the clinics. Two bills sponsored by CDA this year, one dealing with incentives for retired dentists to provide  free care and the other regulation of portable and mobile dental operations, passed the halfway mark in the legislative process last month by receiving unanimous votes in their first houses. After being approved by the appropriate policy and fiscal committees, AB 836 was passed by the full Assembly on April 25 by a 76-0 vote, while the Senate passed SB 562 on May 6 by a 32-0 vote.
